Additional Release of FISA Section 702 Documents

Today the ODNI, in consultation with the Department of Justice, is releasing additional FISA Section 702 documents. Previously, we publicly posted tranches of Section 702 documents after documents were released pursuant to a Freedom of Information (FOIA) case filed in the U.S. District Court, Southern District of New York, ACLU v. National Security Agency, et al. (the ACLU FOIA releases April 11, 2017, May 10, 2017, June 13, 2017, and July 11, 2017).

Today’s release is the latest tranche of documents related to the ACLU FOIA case.

Included in today’s release are reports by the National Security Agency (NSA) that describe the rigorous training required to become an NSA signals intelligence analyst, as well as reports by the NSA’s Office of the Inspector General (OIG). One report, the 2015 annual NSA OIG review, indicated that NSA disseminated 4,318 intelligence reports containing Section 702 information with at least one reference to a U.S. person. Such NSA OIG reviews are based on a September 1st through August 31st time period. The DNI’s 2015 Annual Statistical Transparency Report (previously released on IC on the Record on May 2, 2016) reported that, during calendar year 2015, NSA disseminated 4,290 intelligence reports containing Section 702 information with at least one reference to a U.S. person. The numbers are different because the two different reports cover two different reporting periods.
